2. Engagement Process
Before engaging a new sub-processor, FactoryNerve conducts a due diligence review that includes:
- Security and privacy assessment against FactoryNerve’s standards
- Review of the sub-processor’s SOC 2, ISO 27001, or equivalent certifications
- Contractual commitment to data protection obligations at least as protective as our DPA
- Verification of data processing boundaries and restrictions on further sub-processing
Each sub-processor agreement incorporates Standard Contractual Clauses (SCCs) where required and restricts the sub-processor from processing customer data for any purpose other than the specific service engagement.
3. Objection Mechanism
Customers who have executed a DPA with FactoryNerve may object to the engagement of a new sub-processor on reasonable data protection grounds. To object:
1. Submit a written objection to dpo@factorynerve.online within 14 days of receiving a sub-processor change notification.
2. Provide specific, documented reasons why the new sub-processor cannot provide adequate data protection.
3. FactoryNerve will review and respond within 14 days, proposing a commercially reasonable alternative or explaining why the objection cannot be accommodated.
If the objection cannot be resolved, the customer may terminate the affected services as provided in the DPA.
4. Notification of Changes
FactoryNerve notifies customers of any intended changes concerning the addition or replacement of sub-processors in accordance with our DPA. Notification methods include:
- Email notification to the account owner(s) at least 14 days before the change takes effect
- Update to this sub-processor page, which serves as the official register
